CLIENT CONSENT FOR THE PROCESSING AND EXCHANGE OF THEIR PERSONAL DATA

Data Collection and Use

WHY IS YOUR DATA COLLECTED? WHAT DATA? WHO IS RESPONSIBLE?

  • As part of the assignment you wish to entrust to your real estate agent, they must collect certain information about you in order to carry out the tasks related to this assignment, which are listed precisely on page 2 of this document.
  • Your collected data could be used for another assignment that will necessarily be closely related to that listed on page 2 of this document.
  • The data collected is your identity data, your correspondence and billing address, as well as all data strictly necessary to accomplish the tasks listed on page 2. This data may, if necessary for the processing of your file, be sensitive data, such as proof of income, bank statements or other financial or personal information.
  • This data is collected and used with your consent and in accordance with European and national data protection laws. Even if you decide not to give your consent, your real estate agent will handle your file as best as possible.

Data Management and Security

HOW IS YOUR DATA STORED?

  • Your data is stored in paper and/or electronic file form, under the responsibility of your real estate agent who takes all necessary measures to ensure their security.
  • If your data must be shared for the processing of your file, it will be done through a secure electronic information exchange system.
  • Your data is stored for the duration of the processing of your file. Once your file is closed, your data is stored for a maximum period of 10 years, from the end of your real estate agent's assignment, in order to allow them in particular to respect their obligations in terms of liability.

Data Access and Client Rights

WHO WILL HAVE ACCESS TO YOUR DATA?

  • The collaborators of the "GIPB" team (Mon Chez Toit) will have access to your file, in order to process it.
  • If the processing of your file requires it, this consent form will also authorize your real estate agent to share all data from your file with other real estate agents and actors in the real estate world.
  • If the processing of your file must be done elsewhere than in Belgium, in the European Union (EU), and if you and your real estate agent agree, the data concerning you and which has been collected by your real estate agent may be shared with real estate professionals from other EU countries.
  • Your real estate agent can tell you more about the professional(s) who will take care of your file in these EU country(ies).

WHAT ABOUT A CLIENT DATABASE?

  • You can also tell us if you wish to be contacted as part of information activities organized by your real estate agent or to receive their agency newsletter.

WHAT ARE YOUR RIGHTS?

  • You have the right to give or withdraw your consent for the processing and exchange of your data.
  • If you agree today to give your data and have it processed as part of your file, you can always withdraw your consent later. In this case, your real estate agent will explain to you how your data will be deleted from your file. However, it is possible that not all information can be removed, especially information that has been used to initiate legal action or to defend legal action.
  • You have the right to be informed about the purposes for which your data will be processed and about the people who will have access to your data. Your real estate agent will tell you which people will be associated with the processing of your file and which people will have access to your file.
  • You have the right to ask what information concerning you is recorded and to request corrections, if certain information is not correct.
  • You have the right to receive all information concerning you that is recorded in a portable and readable format.
  • Your real estate agent who directly collects your data is responsible for this data.
  • Your real estate agent has a duty to ensure that your data is processed securely and to warn you if the security of your data is not respected.
